Teen Killed Trespassing While Playing Pokemon Go

A Mariondale N.C. teenager was tragically shot and killed Sunday after trespassing onto private property while attempting to catch a Pokemon in the new gaming sensation Pokemon Go. There have been previous reports of injuries connected to players becoming involved in car crashes while driving and playing at the same time, but this appears to be the first fatality directly connected to playing the game.

15-year-old Arthur Digsby apparently left his house Sunday around 1 a.m., with a friend who was staying over, when the two friends noted a rare Pokemon had appeared in the nearby Pokemon list. The two friends reportedly left the house without notifying responsible adults, and started searching the neighborhood for the rare Pokemon. The friends apparently thought they had pinpointed the rare Pokemon, but could not get close enough to it, because it seemed to be inside a neighborhood home.

The deceased teenager’s friend reports that Arthur first circled the residence, triggering security lights as he attempted to get the Pokemon to appear. He then walked into an enclosed back porch of the residence, and when it still did not appear he started checking windows on the house and attempted to open them.

Homeowner Ellen Jones, a 67-year-old widow who lived by herself in the home, was awoken by the sound of someone trying to open her bedroom window. She then armed herself with a 9mm pistol that had belonged to her deceased husband. She then went to use the telephone to call emergency services where she was surprised by the teenager attempting to gain access to the home through an unlocked kitchen window. The widow panicked and shot at the teen twice, striking him both times.

The teenager was transported to an area hospital with two gunshot wounds to the chest where he subsequently died from the injuries. Mariondale police department has stated that no charges will be filed against the homeowner. Then police department issued a statement enjoining people playing the game to be sensible and respect private property boundaries at all times. Niantic, the company that created Pokemon Go, has not commented on the tragic shooting at this time.

        One day, my grandpa was home alone when burglars entered his house. Also teenagers. They searched around a bit, went upstairs and eventually opened the door to his study. He was surprised as fck that there were people in the house and so were they. They immediately ran away. Didnt even take anything and they never came back.

        I’ll give you that trying to enter a home to get a pokemon is a very stupid thing to do, but shooting at unarmed people without warning is manslaughter in any sane country.

For the purposes of defining the crime of burglary, larceny shall be deemed a felony without regard to the value of the property in question.

      N.C.G.S. § 14-51.2(b): The lawful occupant of a home, motor vehicle, or workplace is presumed to have held a reasonable fear of imminent death or serious bodily harm to himself or herself or another when using defensive force that is intended or likely to cause death or serious bodily harm to another if both of the following apply:
      (1) The person against whom the defensive force was used was in the process of unlawfully and forcefully entering, or had unlawfully and forcibly entered, a home, motor vehicle, or workplace, or if that person had removed or was attempting to remove another against that person’s will from the home, motor vehicle, or workplace.
      (2) The person who uses defensive force knew or had reason to believe that an unlawful and forcible entry or unlawful and forcible act was occurring or had occurred.

Another run where a “child” broke into an elderly woman’s home, pushed her down a flight of stairs, killing her. Another where two “children” looking for money, broke into an elderly man’s home and beat him to death with a hammer when he did not have any money to give them. The lady feared for her life. The intruder placed her in fear for her life. She did not have time to interview the intruder beforehand to determine what his motives were. So, Miss Janice, if you see someone in your home some night after hearing a window break and that person is opening the door to your bedroom…and since you don’t believe in guns, you don’t have one…You going to try to talk him out of hurting you? The woman in the article did get exactly what she deserved..she defended her home and her life. I am sure she feels terrible about it.

She had no idea what or who was at the window or what their intentions were and she did not want to just wait and see. Fear does that to people. Had the kids not been on her property at the window it never would have happened. Tragic for all, including the lady. This “game” is having kids trespass into dangerous places and take risks. We just had two kids caught on video, climb over barriers in pursuit of this game where a fall would have seriously injured or killed them.

      @catfood This is not a “Murrica thing”. Although “Castle doctrine” is most commonly used in the United States, many other countries invoke comparable principles in their laws. The legal concept of the inviolability of the home has been known in Western civilization since the age of the Roman Republic. In English common law the term is derived from the dictum that “an Englishman’s home is his castle”. I don’t know where you live, but normally, if someone is attempting to secretly break into your house in the middle of the night through a window, they are violating your sanctuary, threatening your security and outright breaking the law. Even though the outcome of this particular event is sad (assuming he was really trying to imprudently play a game, and not just using the game as an excuse if he got caught committing the crime), the more typical outcome when a break-in occurs is that the elderly owner ends up being the one killed, raped or robbed. That is why the law normally sides with the home owner. As an owner, I do not possess the power to prevent a random person from deciding to try and break into my home, but as a random person, I have the power to chose not to attempt to break the law and enter another’s home unwelcomed through a window in the middle of the night. The person entering the home had the power to chose NOT to go through with this action which created an unsolicited threat to the owner and violation of their security. Someone standing on your porch at noon knocking on your front door is not the same threat level as an unknown stranger trying to secretly break into your unlocked window in the middle of the night.

    While I don’t know what the laws are in America I just want to say a few things. I’m wondering how he was against the bedroom window. Surely it’d be difficult to get up against a bedroom window if it’s not a bungalow, let alone open it (if it was a bungalow, please let me know). Also, it seems very unlikely to me that a 67 year old woman would hear someone opening or at least trying to open a window and then grab a gun and shoot the teenager twice. Furthermore, why would a 15 year old try to get into someone’s house at 1am. I’d like to think that anyone over the age of 6 would know better than to go out at 1am without telling anyone and try to get into a house. Finally, I know for a fact that the range of you being able to fight a pokemon is quite large. I’ve played it from one end of my street and fought something at the other end. A house surely can’t be as big as a whole street and if it was then it’d have more than 1 floor. Before anyone says anything, I have read the article and quite a few comments so if I’m missing something then could someone fill me in.

      I can only tell you what I heard today via lamestream media. They claim kids / teens / adults are playing this game at night, many late at night. Players have showed up at fire departments, police stations and at businesses to play the game. Criminals are also using the game to lure people (players) into an ambush where they get robbed. I don’t see how this game can do any good, it has already caused plenty of problems.

In some states you can shoot someone on your property, let alone actually entering through a window. The kid, regardless of motive, is guilty. Furthermore, the woman had no idea who the kid was or what his motive was, she had every right to do what she did. But the biggest issue, is anyone blaming the game. The game has a HUGE search radius. Big enough that you don’t need to enter a house to discover a pokémon. if it was there, he’d have found it circling the house. I agree its sad, but the fact is he was completely in the wrong and the woman had no idea what was going on. That kid is responsible for his death, not the woman, not the game, just this kid making a very stupid mistake.

    I would not have fired while the intruder was still outside, but that is only because I hate paperwork. Had he been inside of my house when I found him, and I was satisfied that he had no business being there, I would probably shot. “Unarmed” doesn’t cut it.
